At Marlborough School, we value our community’s support and respect our community’s privacy rights. We are dedicated to the protection of valid privacy interests and to fair information practices. We created this Privacy Policy to explain how we treat the information that we collect and receive from your use of the School’s website, http://www.marlborough.org. We hope that this policy will help you make an informed decision about visiting and using the Marlborough website. Please note that this Privacy Policy applies only to the School’s website, and we are not responsible for the practices of persons, companies, or websites that Marlborough does not control or manage. When this policy refers to “you,” it means any user of the Marlborough website. 

Privacy of Children

Marlborough complies with the Children’s Online Privacy Protection Act (“COPPA”). COPPA forbids website operators, in most circumstances, from knowingly collecting personally identifiable information from anyone under the age of 13 without first obtaining verifiable parental consent. On its website, Marlborough will collect and use personally identifiable information from a child under the age of thirteen only if the School has first received verifiable consent from the child’s parent or legal guardian, as COPPA requires. 

Information That This Privacy Policy Covers

Certain features and benefits on our website may collect or use your Personally Identifiable Information (as defined in this section and in the section below entitled “What Information We Collect”).  Personally Identifiable Information may include your name, date of birth, home address, telephone number, username, e-mail address, IP address, geolocation, operating system, browser, screen resolution, identifiable information stored in digital cookies, and other information.  If you purchase goods or services from the School, other collected information may include your credit card number and checking account number. You are responsible for ensuring the accuracy of the Personally Identifiable Information you submit to Marlborough. Inaccurate information may affect your ability to use the website, the information you receive when using the website, and our ability to contact you.  For example, your e-mail address should be kept current because that is one of the primary manners in which we communicate with you.

What You Consent to by Using Our Website 

By submitting any Personally Identifiable Information to us or by simply using the website, you are agreeing that Marlborough School may collect, use, and disclose your Personally Identifiable Information in accordance with this Privacy Policy, and as permitted or required by law.  If you do not agree with these terms, please do not provide any Personally Identifiable Information to us, and do not use the website.  Please note, however, that if you do not consent to Marlborough’s use of your Personally Identifiable Information, or if you choose not to provide us with any required Personally Identifiable Information, we may not be able to provide you with products or services offered on our website.

What Information We Collect

Through the website, we gather and use various types of information about users. The information described in 1 and 2 below, along with the information discussed above in the section entitled “Information This Privacy Policy Covers,” constitute the “Personally Identifiable Information” we can collect and use through the website:

Persistent Identifiers. When users come to our website, we may track, collect, and aggregate information, called “Persistent Identifiers,” indicating, among other things, which pages of our website were visited, the order in which they were visited, which hyperlinks were “clicked,” and similar information. Collecting such information may involve, for example, logging the IP address, operating system, and browser software used by each user of the website. The information that we may be able to determine from an IP address includes a user’s Internet Service Provider and the geographic location of his or her point of connectivity.

Personal Information. We collect personal information, such as your name, home address, telephone number, username, and e-mail address, that you provide to us when using the website, such as when you send us e-mail messages.  We also use personal information you may provide directly to Marlborough (not via the website) during Marlborough’s registration process in order to set up your account on the website. Among other things, we may collect and use your personal information to respond to your questions, provide the specific services that you select or that are required by your enrollment in the School, send you updates about Marlborough, send you e-mail messages about website maintenance and updates, enable you to connect via the website to web-based services operated by third parties, and inform you of significant changes to this Privacy Policy. The following are examples of some ways that Marlborough may collect or use your personal information: 

Updates. Marlborough may offer you the ability to receive updates via either e-mail or another subscription service such as Facebook or Twitter.  In order to subscribe to these services, you may be required to provide us with personal information such as your name, e-mail address, and zip code.

Registration/Creating a Profile. In order to register your account with the website and create a profile on the website, Marlborough will use some of your personal information. 

Third Parties. Marlborough may provide your personal information to third parties in connection with third party plugins incorporated into the website.

Communications with Marlborough.  We may receive personal information and other Personally Identifiable Information when you send us an e-mail message or otherwise contact us. 

How We Use the Information

Persistent Identifiers.  We use Persistent Identifiers in aggregate form to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users, and by measuring demographics and interests regarding specific areas of our website.  We also provide Persistent Identifiers to the third parties disclosed in this Privacy Policy, to the extent such information is necessary for the third party sites (discussed below) to function effectively. 

Personally Identifiable Information. This Privacy Policy serves as notice that we collect Personally Identifiable Information in the manners described here.  Except as set forth in this Privacy Policy and except as you specifically agree, Marlborough will not disclose any Personally Identifiable Information we gather from you on the website.  In addition to the other uses set forth elsewhere in this Privacy Policy, we may disclose and otherwise use Personally Identifiable Information as follows:

Updates. We use Personally Identifiable Information collected when you sign up for our various e-mail or update services to send you the messages that you request us to send.  We may also archive this information or use it for future communications with you.

Registration/Creating a Profile. We may use Personally Identifiable Information you provided to Marlborough during the School’s registration process to create your online profile. Any images, videos, or other content that you submit to the website (including any Personally Identifiable Information contained in that content) may be distributed through the internet and other media. If you elect to submit content, please refer to the “Safety Tips” section below. We may also archive this information and may use it for future communications with you.  Communications with Marlborough. When you send us an e-mail message or otherwise contact us, we may use the information you provide (including Personally Identifiable Information) to respond to your communication, or we may use it in another way described in this Privacy Policy. We also may archive this information and use it for future communications with you.

Disclosure to Marlborough Operations and Maintenance Contractors. Our operations and maintenance contractors sometimes have limited access to your Personally Identifiable Information in the course of providing products or services to us. These contractors may include vendors and suppliers that provide us with technology, services, or content related to the operation and maintenance of the website. Access to your Personally Identifiable Information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function for us. 

Government Authorities, Legal Rights, and Actions. Marlborough may share your Personally Identifiable Information with various government authorities in response to subpoenas, court orders, or other legal process. We also may share or use it to establish or exercise our legal rights, to protect our property, or to defend against legal claims. We may use or share your Personally Identifiable Information in any other way that is required by law.  At all times we reserve the right to raise or waive any legal objection or right available to us.  We also may use or share your Personally Identifiable Information when we believe that doing so is necessary or appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of the School, its website, our users or customers, or others; and to effectuate or work with other agreements.

Other Third Parties. For your convenience we may provide you with embedded third party plugins and applications in the website that are operated by companies other than Marlborough (“Third Party Sites”) that we believe are important (such as Finalsite, Google Analytics, and Stetler) or that we believe may be of interest to you. Our doing so may entail our using or sharing your Personally Identifiable Information. 

We take reasonable steps to release Personally Identifiable Information only to the Third Party Sites that are capable of maintaining the confidentiality, security, and integrity of such information. We are not responsible for the privacy practices of these Third Party Sites, however, and do not control those sites. Confidentiality & Security of Personally Identifiable Information 

We consider the confidentiality, integrity, and security of your information to be of the utmost importance. We will use commercially reasonable efforts to keep your Personally Identifiable Information private and will not share it with third parties, unless otherwise provided in this Privacy Policy or unless we have a good faith belief that such disclosure is necessary in special cases, such as a physical threat to you or others. In no instance will we provide Personally Identifiable Information of students under the age thirteen to third party website operators other than as permitted under applicable laws. Marlborough takes reasonable measures to protect your Personally Identifiable Information from any disclosure to or access by third parties beyond that permitted under this Privacy Policy.  Please note that we do not guarantee the security of Personally Identifiable Information, and there is some risk that an unauthorized third party may find a way to circumvent our security systems or intercept the transmission of your information over the Internet.

Updating or Deleting Your Personally Identifiable Information

You may change, update, delete, or add to your profile information at any time through the website. You may also e-mail us using the contact information in the “Contact Marlborough” section below, and we can help you with changing or deleting your profile. 

If you are a parent or legal guardian and are concerned about the disclosure of Personally Identifiable Information about your daughter under the age of 13 that we may obtain via the website, use on the website, or provide to Third Party Sites, you may review your daughter’s Personally Identifiable Information. If you wish to have information deleted or to decline to allow any further collection or use of the information., you may discuss those issues with us by contacting Marlborough using the contact information in the “Contact Marlborough” section below. Marlborough might not be able to take those actions itself on your behalf.

Changing Our Privacy Policy

Our website is hosted in the United States and is intended for and directed to users in the United States. United States law governs this Privacy Policy and the use of the website.
